Former PSL star pleads guilty to culpable homicide, sentencing set

The charges against the PSL star relate to a collision on 30 October 2024. It claimed the life of nine-year-old Gomolemo Mavimbela and left two other people seriously injured.

Appearing in the Tembisa Magistrate’s Court, Mogaila admitted in his plea statement that he had negligently caused the collision. According to the National Prosecuting Authority (NPA), his vehicle veered into oncoming traffic on Andrew Mapheto Road before colliding with another vehicle.

The devastating collision resulted in the death of Gomolemo Mavimbela, while her mother and 13-year-old brother were seriously injured.

NPA Communications Officer Magaboke Mohlatlole confirmed that the guilty plea resulted in a conviction on the charges of culpable homicide and failure to render assistance.

“The conviction follows a fatal collision on Andrew Mapheto Road in Tembisa on 30 October, 2024 when Mogaila’s vehicle veered into oncoming traffic and collided with another vehicle,” Mohlatlole said.

“The crash claimed the life of nine year old, Gomolemo Mavimbela, and left her mother and 13 year old brother seriously injured. 


“The NPA welcomes tge conviction as an important step towards securing justice for the victims. Mogaila’s bail has been extended until his next court appearance on 17 November 2026, when he’s expected to be sentenced.”

The AfriForum Private Prosecution Unit had previously opposed proposals that could have resulted in a more lenient outcome for Mogaila. Its spokesperson, Barry Bateman, also expressed disappointment that the former PSL player did not provide a fuller account of his actions leading up to the crash.

SENTENCING SET FOR NOVEMBER

Although the PSL star has now been convicted, the case is not yet over, with sentencing scheduled for 17 November 2026. The former Sekhukhune United player remains out on R20,000 bail, which has been extended until his next appearance.

The NPA said Mogaila is expected to return to the Tembisa Magistrate’s Court on the sentencing date.

The case has brought renewed attention to the consequences of the fatal Thembisa crash, with the family of Gomolemo Mavimbela having lost a nine-year-old child while two other family members suffered serious injuries.
