KOTA BHARU, Nov 1 — The Attorney General’s Chambers (AGC) is considering whether to seek the reinstatement of a murder charge against a senior police officer in the case involving the death of student Muhammad Zaharif Affendi Muhd Zamrie, following the officer’s conviction on a lesser charge of causing death.

Attorney General Tan Sri Mohd Dusuki Mokhtar said the AGC had filed an appeal at the Court of Appeal last week against the Ipoh High Court’s decision, but was still examining the various aspects of the case before deciding on the arguments to be submitted.

He said he had discussed the matter with AGC Prosecution Division head Datuk Masri Mohd Daud and the head of its Trial and Appeals Division.

“We want to examine every aspect of this case, including whether we should submit arguments for the original murder charge to be reinstated, or take any other appropriate action based on the circumstances of the case and the court’s decision,” he said.

Mohd Dusuki was speaking to reporters after attending the launch of the Attorney-General’s Chambers Madani Adopted School programme at Sekolah Kebangsaan Pasir Hor here today.

Asked whether the AGC had identified any gaps or shortcomings in the High Court’s decision, Mohd Dusuki said it was too early to comment as the prosecution had yet to receive the full grounds of judgment.

On October 28, the Ipoh High Court sentenced DSP Mohd Nazri Abdul Razak, 47, to seven years and six months’ imprisonment after he pleaded guilty to an amended charge of causing the death of Muhammad Zaharif, three years ago.

The charge was amended from murder under Section 302 of the Penal Code to one under Section 304(b), which carries a maximum jail term of 10 years, a fine, or both, upon conviction.

The judge ordered Mohd Nazri to serve his sentence from December 15, 2023, the date of his arrest. He was also ordered to pay RM50,000 in compensation to the victim’s father, Muhd Zamrie Zainal Abidin, 58, or face an additional year in prison if he failed to do so.

Mohd Nazri was accused of causing the death of Muhammad Zaharif, 17, near Sekolah Menengah Kebangsaan Jati in Ipoh between 11.55am and 12.32pm on December 15, 2023.

He was initially charged under Section 302 of the Penal Code, which carries the death penalty or imprisonment of between 30 and 40 years and at least 12 strokes of the cane upon conviction. — Bernama
