News24 | ANC takes IEC list battle for 181 excluded candidates to ConCourt

The ANC has approached the Constitutional Court to fight for the reinstatement of 181 candidates who have been excluded from the 4 November local government elections.

The party filed an application for leave to appeal on Tuesday, six days after the Electoral Court dismissed its challenge against the decision of the Electoral Commission of South Africa (IEC) to bar the candidates from contesting in six municipalities.

Documents filed at the court show the ANC is challenging the Electoral Court’s finding that it failed to submit candidate nominations by the 28 August deadline.

The party maintains that candidate information captured on the IEC’s online candidate nomination system before the cut-off time constitutes a valid submission, even though it did not complete the “submit as final” step.

The 181 excluded candidates comprise 130 proportional representation nominees and 51 ward candidates in Mangaung in the Free State, uMshwathi in KwaZulu-Natal, and four Eastern Cape municipalities.
